WE, THE MEMBERS of the Nimar‑Malwa Vikas Party, united by a shared vision of progress, equality, and sustainable development for the Nimar and Malwa regions and the nation at large;

REAFFIRMING our unwavering commitment to the Constitution of India and the values of justice, liberty, equality, and fraternity enshrined therein;

DEDICATING ourselves to the principles of democracy, secularism, socialism, and social justice as guiding lights of our political endeavour;

RECOGNISING the unique cultural, historical, and socio‑economic identity of the Nimar and Malwa regions, and the imperative to preserve and promote this rich heritage while embracing modernity and innovation;

COMMITTING to address the challenges faced by our people – agricultural distress, unemployment, inadequate infrastructure, social inequality – through pragmatic policies and people‑centric governance;

RESOLVING to build a society where every individual, regardless of caste, creed, gender, or economic status, has equal opportunities to thrive and participate in decision‑making;

DO HEREBY adopt, enact, and give to ourselves this Constitution.

Article‑1 NAME, FLAG AND HEADQUARTERS

1.1 Name of the Party: The Party shall be called “Nimar‑Malwa Vikas Party”. The name reflects its commitment to the development of the Nimar and Malwa regions and contains no reference to religion or caste, complying with guidelines of the Election Commission of India.

1.2 National Headquarters: The National Headquarters of the Party is located at: H. No. 35, Ward Number 1, Shiv Shakti Nagar, Kasrawad Road, Sukhpuri, Khargone, Madhya Pradesh, India. Pincode– 451001. It serves as the central administrative hub for membership processing, record‑keeping, financial management, coordination with state and local units, and archival of Party documents. The headquarters may be relocated by a majority vote of the Central Executive Committee, with due notification to the Election Commission of India within thirty days of such decision.

Article‑2 ALLEGIANCE TO THE CONSTITUTION OF INDIA

2.1 Declaration of Allegiance:

    The "Nimar-Malwa Vikas Party" shall bear true faith and allegiance to the Constitution of India as by law established, and to the principles of socialism, secularism and democracy and would uphold the sovereignty, unity and integrity of India.

2.2 Commitment to Constitutional Principles:The Party affirms its unwavering commitment to the fundamental principles enshrined in the Constitution:
Socialism – meaning equitable distribution of wealth and resources, social and economic justice for all citizens, elimination of exploitation, and establishment of a welfare state.
Secularism – meaning equal respect for all religions, impartiality of the State in matters of faith, and protection of the right of every citizen to practise, profess and propagate their religion.
Democracy – meaning adherence to democratic traditions both in the governance of the country and in the internal functioning of the Party, with participation of all members in decision‑making.
Justice – social, economic and political justice for all citizens, ensuring that no individual or group suffers discrimination or deprivation..

2.3 Sovereignty, Unity and Integrity: The Party shall at all times oppose any activity, speech or action that threatens the territorial integrity, national unity or sovereignty of India. Any member found engaging in anti‑national activities shall face immediate disciplinary action, including expulsion from the Party.

Article‑3 OBJECTIVES OF THE PARTY
3.1 Electoral Participation:To actively participate in electoral politics and strengthen democratic institutions by contesting all elections – including those for local bodies (panchayats and municipalities), State Legislative Assemblies, and the Parliament of India – conducted by the Election Commission of India and respective State Election Commissions. To engage citizens through voter education, transparency initiatives and anti‑corruption measures. To comply fully with all provisions of the Representation of the People Act, 1951 (Act Number 43 of 1951) and the Model Code of Conduct issued by the Election Commission.
3.2 Regional Development: To promote the unique cultural, historical and socio‑economic identity of the Nimar and Malwa regions. To advocate for region‑specific policies addressing developmental, cultural and environmental needs. To bridge the urban‑rural divide by improving connectivity, healthcare, education and employment opportunities in rural areas.
3.3 Social Justice: To work for the upliftment of marginalized communities, including Scheduled Castes (SCs), Scheduled Tribes (STs), Other Backward Classes (OBCs) and minorities. To combat caste‑based discrimination and promote social harmony. To ensure equal access to education, healthcare and employment for all sections of society.
3.4 Good Governance: To promote transparency, accountability and citizen participation in governance. To combat corruption and ensure effective implementation of government schemes. To strengthen democratic institutions and promote efficiency at all levels.
3.5 Economic Empowerment: To create employment opportunities through promotion of industries, entrepreneurship and skill development programmes. To support small and medium enterprises and startups through financial and technical assistance. To advocate for equitable distribution of wealth and inclusive economic growth.
3.6 Agricultural Prosperity: To address challenges faced by farmers, including debt, low crop prices and inadequate irrigation. To promote sustainable agricultural practices and provide access to modern technology, credit and markets. To ensure fair compensation through Minimum Support Price (MSP) and implement effective crop insurance schemes.
3.7 Women's Empowerment: To encourage equal and active participation of women in all spheres of society. To implement policies addressing gender‑based violence, discrimination and lack of access to healthcare and education. To promote self‑help groups (SHGs) and provide financial support for women entrepreneurs.
3.8 Youth Development: To empower youth by providing opportunities for education, employment and leadership. To promote sports and physical fitness through infrastructure development and athlete support. To encourage youth participation in community development and nation‑building activities.
3.9 Cultural Preservation: To preserve and promote the rich cultural heritage of Nimar and Malwa, including art, music and traditions. To support local artists, artisans and cultural institutions. To organise cultural festivals and events celebrating the diversity of the regions.
3.10 Environmental Sustainability: To promote environmentally sustainable practices and policies to combat climate change. To encourage afforestation, water conservation and renewable energy projects. To address issues related to pollution, waste management and deforestation.
3.11 National Integration: To uphold the secular fabric of India by fostering interfaith harmony and opposing communalism. To promote balanced regional development and reduce inter‑state disparities. To work collaboratively with central and state governments for national development while addressing specific regional needs.
Article‑4 CORE PRINCIPLES

Each principle is operationalised through: internal democracy (elections every four years, not more than one‑fourth of members nominated), prohibition of veto power, transparency and accountability of office‑bearers, affirmative action for marginalised groups, and regular reporting to the Election Commission of India.


Article‑5 MEMBERSHIP OF THE PARTY

5.1 Eligibility for Membership: Any person who is a citizen of India, has attained the age of 18 years, subscribes to the aims and objectives of the Party, agrees to abide by its Constitution, rules and discipline, is not a member of any other political party, and has not been convicted by any court of law for an offence involving moral turpitude or any criminal offence, shall be eligible to become a member.

5.2 Application Process: Application shall be submitted in writing to the concerned Primary Committee (Village or Ward level) or online through the Party's official website. The application must include full name, permanent address, date of birth, educational qualifications, Voter ID details, two recent passport‑size photographs, a declaration of allegiance to Party objectives, and a declaration that the applicant is not a member of any other political party.

5.3 Fee Structure: The membership fee, as determined by the Central Executive Committee, is currently:

Monthly membership: ₹100 (Rupees One Hundred) Annual membership: ₹1,000 (Rupees One Thousand) – two months free Four‑Year membership: ₹3,600 (Rupees Three Thousand Six Hundred) Life membership (one‑time): ₹10,000 (Rupees Ten Thousand)

5.4 Fee Waivers: Full or partial fee waivers may be granted by the Central Executive Committee to economically disadvantaged persons (Below Poverty Line cardholders, MNREGA workers, monthly income below ₹10,000), students enrolled in recognised institutions, senior citizens above 60 years, and persons with certified disability of 40% or more. Waiver applications must be submitted with supporting documents and are valid for one year, renewable upon review.

5.5 Verification and Approval: The concerned Primary Committee or designated membership verification authority shall verify the details within thirty days of receipt. Upon successful verification, a membership card bearing the member's full name, unique membership number, date of enrollment, photograph and signature of authorised Party official shall be issued. Rejection of application shall be communicated in writing with reasons within fifteen days.

5.6 Term of Membership: Membership shall be valid for a period of four years from the date of enrollment or renewal. Members may renew their membership by submitting a renewal application and paying the prescribed fee before expiry. Membership shall be deemed continuous upon timely renewal.

5.7 Cessation of Membership: Membership shall cease under the following circumstances: (a) voluntary resignation by written notice to the Secretary of the Primary Committee; (b) expulsion following due process of inquiry by the Disciplinary Committee for violation of Party Constitution, anti‑party activities, acts tarnishing Party reputation, criminal conviction, or corruption; (c) automatic termination upon death, joining another political party, contesting any election against a candidate nominated by the Party, or failure to pay membership fees for three consecutive months without approved waiver.

5.8 Non‑Discrimination Clause: The Party shall not discriminate against any individual in matters of membership based on religion, caste, gender, ethnicity, language, or economic status. The Party shall actively promote inclusivity and social justice, ensuring equal opportunities for all members.

Article‑6 RIGHTS AND DUTIES OF MEMBERS

Rights of Members :
(1) Right to vote in elections of office‑bearers within their respective Primary Committee.
(2) Right to contest elections for any position after at least two years of continuous membership.
(3) Right to participate in Party meetings, discussions and decision‑making processes.
(4) Right to access information about Party activities, finances and policies, subject to reasonable restrictions.
(5) Right to freedom of expression within the framework of Party discipline.
(6) Right to appeal against any disciplinary action.
(7) Right to propose amendments to the Constitution through National Council members.
(8) Right to nominate candidates for internal elections.
(9) Right to receive membership card and official recognition.
(10) Right to participate in specialised wings.
(11) Right to attend Party training programmes.
(12) Right to seek redressal of grievances through Dispute Resolution mechanism.

Duties of Members :
(1) To uphold, protect and abide by the Party Constitution, rules and decisions.
(2) To follow and implement instructions and directions of the Party with unwavering commitment.
(3) To maintain strict discipline and decorum in all Party activities.
(4) To actively promote Party objectives, principles and programmes among the public.
(5) To pay prescribed membership fees regularly and on time.
(6) To actively participate in Party meetings, campaigns and activities.
(7) To maintain high standards of integrity and conduct in public and private life.
(8) To refrain from any activity that may bring the Party into disrepute.
(9) To uphold the principle of non‑discrimination and treat all fellow members with respect.
(10) To declare any criminal proceedings or convictions to the Party immediately.

Article‑7 ORGANS OF THE PARTY (ORGANIZATIONAL STRUCTURE)

7.1 Hierarchy: The organizational structure of the Party shall consist of the following bodies in hierarchical order: National Committee, Central Executive Committee, State Committees, District Committees, Block/Taluka Committees, and Village/Ward (Primary) Committees. Each level shall function under the supervision and guidance of the immediately higher committee.

7.2 Specialized Wings: In addition to territorial committees, the Party shall have the following specialized wings: Women's Wing, Youth Wing (for members aged 18 to 35 years), Farmers' Wing, Cultural Wing, Disciplinary Committee, Parliamentary Board, and Financial Committee. Each wing shall have its own office‑bearers elected by its members and shall function under the overall supervision of the corresponding territorial committee.

7.3 Democratic Principles Governing All Organs:
(a) All office‑bearers at all levels shall be elected through a transparent and democratic process.
(b) Fixed tenure of four years for all committees.
(c) No individual shall hold the same office for more than two consecutive terms; a break of at least one term is mandatory after two terms.
(d) No office‑bearer shall have veto power; all decisions shall be made through consensus or majority vote.
(e) Not more than one‑fourth of the members of any committee shall be nominated; the remaining shall be elected.
(f) All appointments and elections shall be conducted transparently with prior notice to all members.
(g) Every office‑bearer and committee shall be accountable to the body that elected them and to higher constitutional authorities.

7.4 Formation of the First National Council: All individuals who come together to form the Party and are present at its first meeting shall constitute the First National Council, which shall serve as the foundational body until the first organizational elections are held in accordance with this Constitution.

Article‑8 OFFICE-BEARERS OF THE PARTY

8.1 Composition: The National Committee shall consist of: (a) Ex‑Officio Members – National President, National National General Secretary, National Treasurer, National Secretaries, National Assistant Secretaries. (b) All State Presidents and State General Secretaries. (c) Elected Representatives – members elected by State Committees on the basis of one representative for every 10,000 members in the respective state. (d) All Members of Parliament (Lok Sabha and Rajya Sabha) belonging to the Party. (e) All Members of Legislative Assemblies and Legislative Councils belonging to the Party. (f) Former Members of Parliament, Legislative Assemblies and Legislative Councils, provided they continue to be Party members in good standing. (g) Nominated Members – not exceeding one‑fourth of the total elected members, nominated by the National President based on expertise and contribution.

8.2 Powers and Functions: (a) To formulate and approve national policies, strategies and programmes. (b) To provide strategic direction to the Party at all levels and oversee functioning of State Committees. (c) To elect the National President, General Secretary, Treasurer, Secretaries . (d) To approve the Party's national budget and monitor fund utilization. (e) To address disputes not resolvable at lower levels through the National Dispute Resolution Committee. (f) To consider and approve amendments to the Constitution by two‑thirds majority. (g) To decide on proposals for merger with any other political party or dissolution of the Party by three‑fourths majority. (h) To represent the Party at national level and advocate for interests of Nimar and Malwa regions.

8.3 Term: Four years.

8.4 Meetings: At least once every year. Special meetings may be convened by the National President or upon written request of at least one‑fourth of members. Notice: 21 days for regular meetings, 10 days for special meetings. Quorum: one‑fourth of total members. Decisions by majority vote; casting vote by presiding officer in case of tie.

Article‑9 CENTRAL EXECUTIVE COMMITTEE (CEC)

9.1 Composition: The Central Executive Committee shall consist of: (a) National Office Bearers (President, General Secretary, Treasurer, Secretaries, Assistant Secretaries). (b) All State Presidents and State General Secretaries. (c) All Members of Parliament belonging to the Party. (d) Members elected by the National Committee from among its members, not exceeding 25% of total CEC strength. (e) Nominated members – not exceeding one‑fourth of elected members, nominated by the National President.

9.2 Powers and Functions: (a) To ensure effective implementation of national policies, decisions and programmes. (b) To oversee day‑to‑day functioning of the Party, including administrative and organizational activities. (c) To prepare and present national budget, monitor fund utilization, and authorize non‑budgeted expenditures. (d) To plan and execute election strategies at national level, coordinate with state and district committees, and oversee candidate selection in consultation with Parliamentary Board. (e) To act as primary link between National Committee and State/District Committees. (f) To exercise emergency powers with approval of National President, subject to ratification at next meeting. (g) To take disciplinary action against any member or unit for violation of Party discipline, subject to appeal to National Committee.

9.3 Term: Four years, coterminous with National Committee.

9.4 Meetings: At least once every three months. Special meetings by National President or upon written request of one‑third members. Notice: 15 days regular, 7 days special. Quorum: one‑third of total members.

Article‑10 STATE COMMITTEES

10.1 Establishment: A State Committee shall be established in each state or union territory where the Party has significant presence, as determined by the Central Executive Committee.

10.2 Composition: Analogous to National Committee at state level: State President, State General Secretary, State Treasurer, State Secretaries, State Assistant Secretaries; all District Presidents and District Secretaries; elected members (one representative for every 1,000 members in the district); all Members of Parliament and Members of Legislative Assemblies/Councils from the state belonging to the Party; former MPs/MLAs/MLCs (if still members); nominated members not exceeding one‑fourth of elected members.

10.3 Powers and Functions: Formulate state‑level policies in alignment with national objectives; coordinate with District Committees; elect state office‑bearers; approve state budget; address disputes through State Dispute Resolution Committee; represent Party in state‑level activities.

10.4 Meetings: At least twice a year. Quorum: one‑fourth of members.

Article‑11 DISTRICT COMMITTEES

11.1 Composition: District President, District Secretary, District Treasurer; all Block/Taluka Presidents and Secretaries; elected members (one representative for every 100 members in the block/taluka); all local body representatives (District Panchayat members, Municipal Councillors) belonging to the Party; former such representatives (if members); nominated members not exceeding one‑fourth of elected members.

11.2 Functions: Implement Party policies at district level; coordinate with Block/Taluka Committees; elect district office‑bearers; approve district budget; address local disputes.

11.3 Meetings: At least twice a year. Quorum: one‑third.

Article‑12 BLOCK/TALUKA COMMITTEES

12.1 Composition: Block/Taluka President, Secretary, Treasurer; all Village/Ward Presidents and Secretaries; elected members (one per 50 members); local panchayat members belonging to Party; nominated members ≤¼.

12.2 Functions: Grassroots coordination, membership drives, implementation of district programmes, local grievance redressal.

12.3 Meetings: At least four times a year (quarterly). Quorum: one‑third.

Article‑13 VILLAGE/WARD (PRIMARY) COMMITTEES

13.1 Basic Unit: Minimum 25 members required to form a Primary Committee. Office bearers: President, Secretary, Treasurer. All members form the General Council.

13.2 Functions: Monthly meetings, membership enrolment, local campaign organisation, public outreach, reporting to Block Committee.

13.3 Meetings: At least once a month. Quorum: one‑third.

Article‑14 SPECIALIZED WINGS (WOMEN, YOUTH, FARMERS, CULTURAL)
👩 Women's Wing: Comprises all women members. Separate office‑bearers at each level (President, Secretary, Treasurer). Advocates gender equality, legal aid for women, self‑help groups, policy interventions for women's health, education and empowerment.
🧑 Youth Wing: Members aged 18 to 35 years. Focuses on skill development, entrepreneurship, sports infrastructure, leadership training, and youth‑centric policies.
🌾 Farmers' Wing: Addresses agrarian issues – debt relief, fair Minimum Support Price, irrigation, crop insurance, sustainable farming practices, and representation of farmers' interests.
🎭 Cultural Wing: Preserves and promotes Nimar‑Malwa folk art, music, dance and traditions; organises cultural festivals; supports local artists and artisans.
Article‑15 DISCIPLINARY COMMITTEE – POWERS, PROCEDURE, APPEALS

15.1 Establishment: Disciplinary Committees shall be constituted at the National, State and District levels.

15.2 Composition: Each Committee shall consist of a Chairperson and four to six members (including legal experts and senior leaders) appointed by the respective Executive Committee. A non‑voting Secretary maintains records.

15.3 Powers and Functions: (a) Investigate complaints of misconduct, violation of code of conduct, or anti‑party activities. (b) Recommend disciplinary actions – warning, censure, suspension (maximum one year), or expulsion. (c) Hear appeals from lower‑level disciplinary bodies. (d) Recommend preventive measures and conduct awareness programmes.

15.4 Procedure: (a) Complaint in writing with evidence. (b) Preliminary review to determine merit. (c) If full inquiry warranted, accused member notified and given opportunity to present case; witnesses may be summoned. (d) Decision by majority vote, with written reasons. (e) Appeal to next higher Disciplinary Committee within 30 days. National Disciplinary Committee's decision final.

Article‑16 PARLIAMENTARY BOARD

16.1 Composition: National President (Chairperson), National General Secretary, National Treasurer, Leader of the Party in Parliament (if any), five members elected by the Central Executive Committee, and up to three members nominated by the National President (not exceeding one‑fourth of elected members).

16.2 Functions: (a) Select candidates for elections to Parliament, State Legislatures and local bodies based on capability, integrity and winnability. (b) Formulate electoral strategies and campaign plans. (c) Coordinate with state and district committees for region‑specific campaigns. (d) Monitor election performance and conduct post‑election reviews. (e) Resolve disputes related to candidate selection.

16.3 Meetings: As often as necessary, especially during election periods. Quorum: one‑third of members.

Article‑17 FINANCIAL COMMITTEE

17.1 Composition: National Financial Committee: National Treasurer (Chairperson), all State Treasurers, three members elected by Central Executive Committee, and up to two members nominated by National Treasurer (not exceeding one‑fourth). Similar structures at State and District levels.

17.2 Functions: (a) Prepare annual budget for approval by respective Council.
(b) Oversee day‑to‑day financial operations, ensure accurate recording of income and expenditure.
(c) Monitor fund utilization for permissible political activities.
(d) Arrange annual audit by Chartered Accountant empanelled with Comptroller and Auditor General of India.
(e) Ensure compliance with Election Commission of India reporting requirements – submit audited accounts and contribution reports within six months of financial year end (by 30th September).
(f) Publish summary of audited accounts on Party website.

Article‑18 TERM OF OFFICE AND ELECTIONS

18.1 Term: All committees shall have a fixed term of four years. Office‑bearers shall continue until their successors are duly elected.

18.2 Organizational Elections: Elections shall be held every four years. The fourth year of the tenure shall be designated the election year. Schedule: Member renewal and enrolment (January‑April), Primary Committee elections (July‑August), Block/Taluka (September‑October), District (October‑November), State (November‑December), National Committee (December). Central Election Authority (independent) shall supervise all elections.

18.3 Eligibility to Contest: For Village/Ward: one year membership; Block/Taluka: two years; District: three years; State: five years; National: seven years. Candidates must not have criminal convictions involving moral turpitude.

18.4 Term Limits: No individual shall hold the same office for more than two consecutive terms. After two terms, a break of at least one term is mandatory.

18.5 Casual Vacancies: Filled by nomination by respective President with approval of next higher committee, for remainder of term.

Article‑19 MEETINGS AND PROCEDURES

19.1 Types: General Council meetings, Executive Committee meetings, Special meetings.

19.2 Notice: National Committee – 21 days (regular), 10 days (special);
Central Executive Committee – 15/7 days;
State/District – 15/7 days;
Block – 7/3 days;
Village – 7/3 days.

19.3 Quorum: National Committee – one‑fourth; Central Executive Committee – one‑third; State Committee – one‑fourth; District – one‑third; Block – one‑third; Village – one‑third. If quorum not met, meeting adjourned for 30 minutes; then members present constitute quorum.

19.4 Presiding Officer: President of respective committee, or in absence, or a member elected by those present.

19.5 Agenda and Minutes: Agenda prepared by Secretary in consultation with President. Minutes recorded, confirmed at next meeting, signed by presiding officer, and maintained in official records.

19.6 Decision‑Making: Normally by consensus; if not, by majority vote. Presiding officer has a vote and casting vote in case of tie. No veto power.

19.7 Virtual Meetings: Permitted if physical attendance not feasible, provided all members can participate and vote.

Article‑20 PARTY FUNDS & ACCOUNTS

20.1 Sources of Funds: Membership fees, voluntary donations from Indian citizens and lawful sources, contributions from fundraising activities, and any other lawful sources approved by Central Executive Committee.

20.2 Restrictions: No contribution shall be accepted from foreign sources (except as permitted by law), government companies or undertakings, or anonymous sources exceeding ₹20,000 (Rupees Twenty Thousand). All donations exceeding ₹20,000 must be disclosed to Election Commission of India under Section 29C of Representation of the People Act, 1951. Donors contributing above ₹2,000 must provide PAN or Aadhaar details.

20.3 Bank Accounts: Dedicated bank accounts operated jointly by authorised office‑bearers. Separate accounts for election‑related expenditures.

20.4 Utilisation of Funds: Funds shall be used exclusively for political activities as defined under the Representation of the People Act, 1951 – election campaigns, Party meetings, literature, administrative expenses, welfare programmes, legal expenses. No personal gain or unrelated activities permitted.

20.5 Maintenance of Accounts: Accounts maintained on accrual system, including all income sources, detailed expenditures, bank statements and supporting documents, in accordance with Election Commission guidelines.

20.6 Audit: Annual audit by a qualified Chartered Accountant from the panel of the Comptroller and Auditor General of India. Auditor verifies accuracy and compliance.

20.7 Submission to Election Commission of India: Audited accounts, along with auditor's report and contribution details, shall be submitted within six months of the end of the financial year (by 30th September). A summary shall be published on the Party's official website.

Article‑21 DISPUTE RESOLUTION AND DISCIPLINE

21.1 Code of Conduct: All members must adhere to integrity, uphold Party principles, refrain from discrimination, corruption, violence, and any act that brings the Party into disrepute.

21.2 Informal Resolution: Members encouraged to resolve disputes amicably through dialogue at local level.

21.3 Formal Complaint: If informal resolution fails, written complaint may be submitted to the Dispute Resolution Committee at appropriate level.

21.4 Investigation and Decision: Committee investigates, hears both parties, and decides within 30 days. Decision with reasons communicated in writing.

21.5 Disciplinary Actions: Warning, censure, suspension (maximum one year), or expulsion. Show‑cause notice mandatory before any action.

21.6 Appeal: Within 30 days to next higher Disciplinary Committee. National Disciplinary Committee decision final.

Article‑22 PARTY CONSTITUTION'S AMENDMENT PROCEDURE

22.1 Proposal: Any member of the National Committee may propose an amendment by submitting a written proposal to the National General Secretary, stating the specific clause(s), proposed text, and rationale.

22.2 Review by Central Executive Committee: The Central Executive Committee shall review the proposal and, if approved, include it in the agenda for the next National Committee meeting.

22.3 Notice: Notice of proposed amendment, with full text, shall be circulated to all National Committee members at least 30 days before the meeting.

22.4 Approval: Requires two‑thirds majority of members present and voting in the National Committee. Voting by secret ballot.

22.5 Ratification and Implementation: Upon approval, ratified by National President, published on Party website, circulated to all units, and submitted to Election Commission of India within 30 days.

Article‑23 MERGER, SPLIT AND DISSOLUTION PROCEDURE OF THE PARTY

23.1 Merger: Proposal may be initiated by Central Executive Committee or by resolution passed by two‑thirds of State Committees. Special National Committee meeting required; approval by three‑fourths majority. Merger agreement signed, registered with Election Commission of India.

23.2 Split: Similar procedure – three‑fourths majority of special National Committee meeting. Assets and liabilities divided per agreement.

23.3 Dissolution: Requires three‑fourths majority of special National Committee meeting. Assets settled per approved plan (liabilities first, surplus to charitable purpose). Notified to Election Commission of India.
